Acceptance of Terms
By accessing or using the BreathHold mobile application and website at breathhold.co (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
Description of Service
BreathHold is a breath hold and apnea training application that provides CO₂ tolerance tables, O₂ tables, guided breathing sessions, progress tracking, and educational content related to breath holding and freediving. The Service is available on iOS, Android, and the web.
User Accounts
You may be required to create an account to access certain features of the Service. When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the application
- Interfere with or disrupt the Service or its servers
- Scrape, crawl, or use automated means to access the Service without permission
- Impersonate any person or entity
- Redistribute, sublicense, or resell access to the Service
Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, video, software, and training algorithms — are owned by BreathHold and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.
Health & Safety Disclaimer
Breath holding can be dangerous and, in certain circumstances, life-threatening. Please read this section carefully.
- Always consult a qualified physician before beginning any breath hold or apnea training program, especially if you have cardiovascular, respiratory, or neurological conditions.
- Never practice breath holding alone in or near water. Shallow water blackout can occur without warning and can be fatal.
- Do not practice breath holding while driving, operating machinery, or in any situation where loss of consciousness could cause harm.
- Stop training immediately if you experience dizziness, tingling, chest pain, or any unusual symptoms.
- The Service provides training tools and educational content only. It is not a substitute for professional medical advice, diagnosis, or treatment.
By using the Service, you acknowledge that you understand the inherent risks of breath hold training and assume full responsibility for your safety.
Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Training results may vary between individuals.
Limitation of Liability
To the maximum extent permitted by applicable law, BreathHold and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service — whether based on warranty, contract, tort, or any other legal theory — even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
Subscriptions & Payments
Certain features of the Service may require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play Store, and are subject to the terms and refund policies of the respective platform.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's app store settings.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property, disclaimers, limitation of liability, and governing law.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of South Africa. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
